What the form asks for

In the order of the official instructions for Form 205:

  1. Entity name with an organizational designation, distinguishable from names already on file (BOC chapter 5).
  2. Registered agent (a Texas resident individual or an entity registered in Texas) who has consented, and a Texas street address for the registered office. The LLC cannot be its own agent; a mailbox service alone is not allowed.
  3. Governing authority: say whether the LLC has managers (list each manager) or not (list each initial member), with a name and address for each.
  4. Purpose: the form uses a general lawful purpose; professional LLCs use Form 206 instead.
  5. Initial mailing address (required since January 1, 2022); the Comptroller uses it for tax mail.
  6. Effectiveness: on filing, or delayed up to 90 days after signing.
  7. Organizer signature. One organizer is enough, 18 or older or an entity, no residency requirement. Notarization is not required.

Checking the name first: Preliminary name availability: (512) 463-5555 or 7-1-1 relay, or email. A preliminary answer is not final.

Do not include with the filing: the instruction pages, duplicate copies, personal identifying information. The official page says including them may get the filing rejected.
